Notice and Takedown Procedure

Golf Tread adheres to prompt responses to valid notifications of copyright infringement as provided in the United States Digital Millennium Copyright Act (DMCA).

The form of such notifications complies with the guidelines stated in the DMCA.

By using any part of Golf Tread, users agree to abide by all relevant copyright laws.

In case Golf  Tread receives a valid notice of copyright infringement, it will undertake to remove or block access to the allegedly infringing materials, which include footwear reviews, images, and product specifications, as well as terminating the account of the respective user, notwithstanding whether or not Golf Tread may be liable for such infringement under the U.S. or any other law.

Designated Agent

Golf Tread has appointed the following individual as its Designated Agent to receive notices of alleged copyright infringement under the DMCA. Upon receipt of a valid notice of infringement from the Designated Agent, Golf Tread will take action according to the policy described below and the DMCA.

Infringement Notification

If your copyrighted work — e.g., proprietary shoe photography, product copy, editorial sizing guides — is being used on Golf Tread  in a manner that infringes upon copyright law or your intellectual property rights, please include the following information in writing to the Designated Agent above:

  • Description of the copyrighted work being infringed;
  • Sufficient information to identify the allegedly infringing material, including URL links;
  • Your full legal name, address, telephone number and email address;
  • A statement that you believe in good faith the material has been used in a manner that constitutes copyright infringement; and
  • A physical or electronic signature of the copyright owner or authorized representative

Please note that, under 17 U.S.C.

  • 512(c)(3)(B) of the DMCA, substantially complying with these requirements is necessary in order for your infringement notice to qualify as “actual notice” under the DMCA.

 

Counter Notification

Content posters whose material has been notified of infringement under the DMCA may file a counter notification. To file a counter notification, you must provide the following information in writing to the Designated Agent above:

  • The description of the material that was removed or to which access has been disabled, and its original location;
  • Full name, address, telephone number, and e-mail address;
  • Agreement to the jurisdiction of the Federal District Court for the district in which your address is located (or, if your address is outside the United States, any judicial district in which Golf Tread  may be found);
  • Agreement to accept service of legal process from the person who provided the original infringement notification or such person’s agent;
  • Statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of a mistake or misidentification

Upon receipt of a proper counter-notification, GolfTread.com will promptly forward a copy to the original complaining party informing him/her that the removed material will be restored within ten (10) business days. Unless the copyright owner files a lawsuit for a court order against the content provider or user within this ten-day period, GolfTread.com will proceed to restore the material. will stop seeing advertisements altogether, as you may still encounter non-personalized ads.
